: In Texas, you can apply for a lost title.With a little help from your local Tax Assessor-Collector, there is a form (affadavit) that must be filled out, the vehicle must be weighed, a rubbing of the VIN (in our Model A case, the engine number) and I believe a photo also.This is sent in thru the Tax A-C's office to the Motor Vehicle office in Austin.The search takes a while but you can eventually get a clear title.

The information John provided is quite correct, I just completed the process with my Town Sedan.Let me add the following.Be sure to get the following documentation when making your purchase as it must be provided.

1.Bill of Sale signed by buyer, purchaser, and a witness.(Must contain make, model, year, and VIN.)

2.Affavidavit of Lost Title, signed by seller,purchaser, and
Witness (must contain vehicle make, model, year, and VIN)

3.Proof of purchase price:I suggest that you pay with a cashier's check and retain a copy of it.This will confirm that the seller received the funds.

With these documents in hand you file a request for a title with the Texas Department of Transportation, Vehicle Titles and Registration Division.They will send you a rejection
letter and copy it to your local Tax/Assessor-Collector.When you get this letter, go down with the forementioned documentation, the letter of rejection, forms for the VIN tracing will be provided to you, and a photo of the car.A title hearing will be scheduled and with this documentation a title issued.A 15 day waiting period is required before the hearing.It is my understanding, that this procedure applies to Texas vehicles only, if you are doing an out of state purchase a different procedure may be followed.I STRONGLY SUGGEST THAT YOU CHECK WITH YOUR LOCAL MOTOR VEHICLE REGISTRATION OFFICE-TAX COLLECTOR/ASSESSOR. If I was purchasing an out of state car it might be wise for the seller to get a title in his state and simply transfer it to you.I purchased my car on April 10, 1998 and just got the title and plates yesterday.Hope this helps.
